COVID-19 Response and Continuity Plan for 2020

Updated Monday, May 18, 2020 – New York, NY – As a result of the ongoing COVID-19 global pandemic, ClubVMSA has canceled all in-person physical events for 2020.  Going forward, ClubVMSA will focus on providing world-class virtual events, content and connection opportunities with networking and breakouts.

Cancellation of In-person physical Events

All scheduled in-person physical events in 2020 are canceled, including:

  • Enterprise Meetups (MMC in Boston, US Cellular in Chicago, TR in Minneapolis)
  • MSP/Supplier Summits (New York and San Francisco)
  • Direct Sourcing Summits (New York, Minneapolis and Belgium)
  • Conferences (VMSA West 2020 and VMSA East 2021)

Prepaid Tickets for Canceled Events

All payments made for canceled event tickets are credited in the member’s account and are valid to redeem through June 30, 2021.

Use ticket credit for Sponsorship and get 10% more!

To encourage companies to use their ticket credits in 2020, they may trade in $1.00 worth of ticket credit for $1.10 worth of sponsorship opportunities to any 2020 event.  For example, if a member has $2,000 in credit for prepaid tickets for VMSA West, they can exchange that credit for $2,200 in sponsorship opportunities. Ticket Credits may not be used for membership dues unless a member wishes to upgrade their Contributor membership to higher tiers such as “Power Player” or “Community Leader”.  In order to earn the additional $.10 on the dollar, companies must use the entire credit before September 30, 2020 and be members in good standing with ClubVMSA.

Refunds

We understand and are deeply sensitive to the financial strains the present public health crisis is placing on many of our businesses. As we all know, the current situation is constantly evolving. Once we re-establish in-person events, we will be able to advise members of what the ClubVMSA policy will be regarding refunds.

Prepaid Tickets for Postponed Events

All prepaid tickets are eligible for transfer to a co-worker or credit of equal value for an in-person event anytime through June 30, 2021.

The Communications Decency Act or “CDA”, 47 U.S.C. § 230(c)(1), states, “No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.” Because the information supplied to this list is authored by users of VMS Accelerator’s, Inc. site, we cannot be legally regarded as the “publisher or speaker” of that information. The same law applies to sites like Facebook or GlassDoor – users who post information on these sites are responsible for what they write, but the operators of the sites are not. This is also consistent with our website Terms of Use.

The reasons for this law are to protect free speech and to encourage the availability of information on the Internet. See generally Batzel v. Smith, 333 F.3d 1018, 1027-28 (9th Cir. 2003) (recognizing, “Making interactive computer services and their users liable for the speech of third parties would severely restrict the information available on the Internet.”). See also Caraccioli v. Facebook, Inc., 167 F. Supp.3d 1056, 1065 (N.D. Cal. 2016) (purpose of CDA immunity is “to spare interactive computer service providers the ‘grim choice’ of becoming fully responsible for third-party content” by permitting them some ability to edit third-party content without also becoming liable for all defamatory or otherwise unlawful messages that they do not edit or delete.) We cannot possibly monitor the accuracy of the huge volume of information we are receiving for this list. If interactive websites were liable for information that the site did not create, this would restrict free speech, as fewer and fewer sites would be willing to permit users to post anything at all.
